Who we are?

ALHUDHAIFI for Intellectual Property Services and Consultancy, is an IP Firm, specialized in the registration and protection of intellectual property rights such as trademarks, patents, industrial designs, copyrights, contractual licenses, domain names etc. We provide our services to individuals, SMEs, institutions and companies. Our IP Firm has been established by Mr. Abdu Abdullah Alhudhaifi, the former Director General of Intellectual Property Department, Ministry of Industry and Trade, Yemen. We have a team work who is well experienced in the field of intellectual property rights for many years. Our mission is to work in a competitive manner to preserve our client's rights and achieve their interests and to provide high and efficient quality services. We are working to help clients avoid IP infringement litigation as much as possible.

Founder

Mr. Abdu Alhudhaifi, Specialist and expert in intellectual property aspects. Former Registrar of Trademarks, Patents and Industrial Designs, Ministry of Industry and Trade, Yemen, for eight years. He also served as director of Trademark Department for a period of ten years. He also worked, a period of four years, IP Expert with the EU project support Yemen's accession to the WTO. He has participated in many seminars, workshops, training and qualification activities and attended conferences related to intellectual property aspects at national, regional and international levels. He also participated in the negotiations of Yemen's accession to the World Trade Organization (WTO) in Geneva on intellectual property matters. He has contributed in the review, preparation and promulgation of IP laws, regulations and Yemen's accession to the Paris Convention for the Protection of Industrial Property and the Berne Convention for the Protection of Literary and Artistic Works. Representing Yemen in several meetings of the Standing Committees in the World Intellectual Property Organization WIPO.

About the trademark :

  • A trademark is a sign used to identify products or services. A trademark may consist of names, words, letters, numbers, phrase, symbol or combinations of these elements.
  • The term of protection of the trademark is ten years from the date of filing the application. The protection of the trademark shall continue as long as it has been renewed each for like period(s).
  • Yemen applies the tenth edition of the Nice Classification. Excluded from the registration are all products in class 33, alcoholic in class 32 and pork meat in class 29.
  • A separate application should be submitted for each class.
  • Priority could be claimed within 6 months from the priority date.
  • Opposition may be filed within ninety days from the date of publication in the Official Gazette.

Documents required to file a trademark application:

  • A legalized POA duly up to Yemen Consulate and MOFA.
  • A copy of the certificate of incorporation or an extract from the commercial register that includes name, address and the objectives of corporation (no need for legalization)
  • Identical photos of the trademark in jpg format
  • List of goods or services.
  • A copy of the priority document in case of claiming priority.

About Patents :

  • A patent is an intellectual property exclusive right granted for an invention, which is a product or a process or both that provide a new solution to a technical problem
  • The term of protection of the patent is 20 years from the date of filing the application
  • Opposition may be filed within ninety days from the date of publication in the Official Gazette.

Documents required to file a patent application:

  • A legalized POA duly up to Yemen Consulate and MOFA.
  • A copy of the certificate of incorporation or an extract from the commercial register that includes name, address and the objectives of corporation (no need for legalization)
  • Abstract, background, summary, detailed description, conclusion and claims of invention.
  • A copy of the priority document in case of claiming priority.

Industrial Designs :

  • An industrial design constitutes the ornamental appearance or aesthetic aspect of a product
  • The term of protection of the industrial design is 10 years
  • Opposition may be filed within ninety days from the date of publication in the Official Gazette.

Documents required:

  • A legalized POA duly up to Yemen Consulate and MOFA.
  • A copy of the certificate of incorporation or an extract from the commercial register that includes name, address and the objectives of corporation (no need for legalization)
  • The purpose of design and items to be protected (claims)
  • A copy of the priority document in case of claiming priority.

Copyright :

  • A copyright is a type of intellectual property that gives the owner exclusive and legal rights to reproduce, publish, sell, or distribute work.
  • Law No. 15 of 2012 on the Protection of Copyright and Related Rights.
The following works are protected:

  • Written or printed works such as books, brochures, magazines, newspapers, websites, and other written materials.
  • Musical works.
  • Photography compilations.
  • Acting and theatrical works.
  • Audio and audiovisual works.
  • Drawing, engraving, decoration.
  • Stereoscopic works.
  • Computer programs & Databases.

Filing Requirements:

  • A copy of the art work.

Domain Names :

  • The Domain name is used to identify one or more IP addresses on the internet.
  • Yemen net is the competent authority responsible for the registration of domain names.

Documents required:

  • Power of attorney.
  • Official fees $ 40 (annually).

    The Republic of Yemen is located in the southern of the Arabian Peninsula in Western Asia (Sana'a is the capital city). Population in Yemen in 2019 is estimated at 29 million people. It is bordered by the Red Sea to the west, the Gulf of Aden to the south, Arabian Sea and Oman to the east and Saudi Arabia to the north.

    • The Ministry of Industry and Trade is responsible for the industrial property as the trademarks, patents and industrial designs.
    • The Ministry of Culture is responsible for literary property related to copyright and related rights.
    • Ministry of Communications and Information Technology Responsible for the domain names.
  • Membership in international agreements related to intellectual property :

    Yemen is a member of the Paris Convention for the Protection of Industrial Property, the Berne Convention for the Protection of Literary and Artistic Works and the Agreement Establishing the World Intellectual Property Organization WIPO and a member of the World Trade Organization WTO.
